Things You Need to Know
We founded Hokia Australia Pty Ltd with one goal in mind: giving our customers a fair, rewarding and enjoyable shopping experience. We conduct business according to the same values, knowing that better service equals loyal customers. TERMS AND CONDITIONS
The Terms and Conditions herein shall be incorporated in all agreements between Hokia Australia Pty Ltd ABN: 77 655 630 701 (“Hokia Australia Pty Ltd”) and its Customers (the person/s named as “the Customer” in the quotation and/or Invoice). In the event of any inconsistency between these Terms and Conditions and the further Conditions stated in the Quotation or Invoice, the further Conditions shall take precedence.
1. All work undertaken will be discussed and agreed prior to the start date and all work will be completed from the original design by Hokia Australia Pty Ltd unless otherwise agreed.
2. The estimate/original price for work includes all materials and labour specified as part of the original design, supplied by Hokia Australia Pty Ltd, unless arranged prior to commencement date or upon initial first visit.
3. Errors and changes to the original plan by Hokia Australia Pty Ltd are accepted on all quotes which will be discussed with the customer.
4. The customer will be responsible for all payments to Hokia Australia Pty Ltd, unless otherwise notified in writing prior to commencement.
5. Payment methods are cash or internet bank transfer.Hokia Australia Pty Ltd will not accept payment plan/s or “Gift/s” or “Item/s of Value” as payment.
6. Hokia Australia Pty Ltd require a non-refundable $1000 holding deposit payable immediately after confirmation of quote.
7. The first instalment is required up to 1-3 weeks prior to work commencing (depending on materials) so materials can be purchased/ordered for the start date of the agreed work.
8. Progress payments will be due as a prior arrangement has been made with Hokia Australia Pty Ltd.
9. Final payment must be made by the customer within 3 days when all the work is completed.
10.Hokia Australia Pty Ltd understand and will exercise their statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if they are not paid according to agreed credit terms.
11. Any addition and/or alterations to the schedule/project shall be discussed with the customer and agreed upon in writing. Any service provided by Hokia Australia Pty Ltd to the customer in excess of that specified in the quotation shall be subject to further charge and performed as soon as reasonably practicable.
12. Extra charges will apply if the customer changes their mind after the service is completed and or changes mind on products after they have been delivered.
13. The customer shall provide water and electricity, if needed, at no charge to Hokia Australia Pty Ltd.
14. The customer shall provide access to the site during Hokia Australia Pty Ltd normal working hours and storage space for materials during the contract progress.
15. Hokia Australia Pty Ltd will not take responsibility for any damage to (or cost involved with) any underground hazards, obstructions or services not made known to Hokia Australia Pty Ltd in writing or apparent on visual inspection. This must be advised or visually brought to any staff or contractor on site/s attention on the first visit or duration of the visit.
16. Hokia Australia Pty Ltd are not able to accept responsibility for the well-being and maintenance of living plant material, including turf, following practical substantial completion unless a maintenance contract is in existence. Maintenance is not included in the contract unless specified.
17. If necessary, Hokia Australia Pty Ltd reserve the right to substitute any plant with another of equal value and growth/habitat/colour in accordance with the specification.
18. After practical substantial completion, Hokia Australia Pty Ltd are not able to accept responsibility for any damage through the elements, including drought, winds, rain and frost to any products or material(s) including plants.
19. It is very important and the sole responsibility of the customer to ensure Hokia Australia Pty Ltd are made aware of any special/statutory bylaws/conditions/permissions that may be involved. Hokia Australia Pty Ltd cannot accept responsibility for subsequent weed growth on completion of the project.
20. Hokia Australia Pty Ltd accept no responsibility for works that have been carried out on land that is not under the ownership of the customer and it is assumed that all planning laws or regulations have been applied before the commencement of any works.
21. Delays caused by other companies on site may cause work to be rescheduled and charges may be made in certain circumstances.
22. All materials, hard and soft landscapes on site including plant/s remain the property of Hokia Australia Pty Ltd until payment is received in full and Hokia Australia Pty Ltd reserve the right to remove said property if the unpaid debt remains after 90 days.
RETURNS AND REFUNDS
1. General returns: a. You may initiate a return of any stock item(s) within 7 days of purchase if you change your mind or identify an error in your purchase. b. Items must be in their ORIGINAL NEW condition, unused, and accompanied by proof of purchase. c. Please be aware that our products are stored undercover; thus, they cannot be accepted for return if exposed to the weather. d. Refunds will be credited to your nominated bank account within two business days, subject to restocking fees and applicable freight charges if item(s) require pickup.
2. Damaged or Faulty Products: a. In the event of receiving damaged, faulty, or incorrectly described products, you must contact us to return them or arrange for our pickup within 7 days to qualify for a full refund.
3. Custom-Made or Specially Ordered Items: a. Custom-made, specially ordered, or items cut to size or processed uniquely cannot be refunded unless they are found to be damaged or faulty.
Note: Please carefully inspect your purchases upon pick-up or delivery. Any claims for damaged or faulty items, as well as general returns, must be initiated within the specified time frame mentioned in this policy to be eligible for refunds. We reserve the right to assess and apply restocking fees, as well as freight charges for returned items.
